Terms & Conditions of Trade (Services)
These Terms & Conditions apply to all quotes, bookings, and services supplied by Quality Floors by Max Francis (“we”). By accepting a quote, paying a deposit, or allowing us access to start work, you agree to these Terms.
1. Quotes & scope
- Quotes are based on information available at the time (m², timber condition, access).
- Unless stated otherwise, quotes are valid for 30 days.
- If we discover conditions that differ from the quote (e.g., subfloor issues, hidden fasteners, glue residues, moisture damage, unevenness), we will discuss variations and any additional costs before proceeding.
- Price includes the coatings/finishes specified in the quote; changes to finish type, sheen, or number of coats may affect price and timeline.
2. Booking, deposits & payment
- We may require a deposit to hold a booking.
- Progress payments may apply for multi-day jobs.
- Final payment is due on completion unless otherwise agreed in writing.
- Accepted payment methods: [list methods].
- Title to any supplied materials remains with us until full payment is received.
3. Access, preparation & site conditions
- You are responsible for ensuring clear access, power, lighting, ventilation, and parking (parking fees or permits may be added to the invoice).
- Furniture/appliances removal is your responsibility unless our quote explicitly includes it. We can arrange this on request.
- Pets and children must be kept away from the work area for safety and to avoid dust/finish contamination.
- We take reasonable care to protect adjacent areas; however, minor dust may occur despite dust extraction.
- You must advise us of any known moisture issues, leaks, prior coatings (e.g., wax/shellac), previous repairs, or asbestos risks.
4. Sanding & coating
- We prepare and sand through appropriate grits to achieve a uniform surface.
- We apply coatings per manufacturer guidance and site conditions.
- Curing times vary by product and climate. We will provide written walk-on and furniture/rug timing. Early traffic or covering may mark the finish.
- Colour/appearance may vary due to timber species, age, prior exposure, and lighting. Natural features (grain, knots, filler tone) are not defects.
5. Repairs & exclusions
- Where repairs are quoted, we will endeavour to match species and appearance; an exact match cannot be guaranteed.
- We are not responsible for pre-existing damage, structural movement, moisture ingress, or issues outside our control.
- Decks and outdoor areas are subject to weathering; maintenance coats are required.
6. Variations & delays
- If unexpected issues arise or access is delayed, we may reschedule and/or charge for additional time/materials at our current rates.
- We are not liable for delays caused by weather, supplier shortages, tenant access, or other factors beyond our reasonable control.
7. Warranties & Australian Consumer Law
- We provide workmanship in a proper and workmanlike manner.
- Our services come with guarantees that cannot be excluded under the ACL. You are entitled to a remedy for major failures and for other reasonably foreseeable loss or damage.
- Any additional warranty we provide is in addition to your ACL rights and subject to proper care and maintenance.
8. After-care & maintenance
- We supply an after-care guide. Following it helps maximise service life and appearance.
- Avoid moisture, abrasive cleaners, or dragging furniture. Use felt pads and mats; maintain per guide and coating manufacturer advice.
9. Cancellation
- If you cancel within [X] business days of the start date, we may charge a cancellation fee to cover lost time and materials ordered.
- If we need to reschedule due to circumstances beyond our control, we will aim to provide a prompt alternative date.
10. Limitation of liability
- To the maximum extent permitted by law, our liability is limited to re-supplying the services or paying the cost of having the services supplied again, at our election.
- We are not liable for indirect or consequential loss. Nothing in these Terms limits your non-excludable rights under the ACL.
11. Photos & marketing
- With your consent, we may take before/after photos for our records and marketing (we won’t identify your address). You can withdraw consent at any time.
12. Disputes
- Please raise concerns promptly so we can resolve them. If not resolved, either party may refer the matter to QBCC (where applicable) or another agreed dispute process.
13. Governing law
These Terms are governed by the laws of Queensland, Australia. The parties submit to the exclusive jurisdiction of its courts.
